Welcome to myCRMSIM, a service provided by JAG Digital. This Terms of Service Agreement ("Agreement") governs your use of myCRMSIM, including all related tools, features, and functionalities offered by our software that allows users to connect their mobile phones to their Customer Relationship Management (CRM) systems to send text messages to contacts ("Service").

By accessing or using our Service, you agree to be bound by the terms and conditions set forth in this Agreement and our Privacy Policy. If you do not agree to these terms, please do not use our Service.

1. Acceptable Use Policy

You agree to use our Service only for lawful purposes and in compliance with all applicable local, state, national, and international laws and regulations regarding the transmission of electronic communications. 

Specifically, you agree not to:

  • Send Unsolicited Messages: Do not send messages to individuals who have not explicitly opted in to receive messages from you. Consent is required before any messages can be sent.

  • Use Purchased Lists: Do not send messages to contacts obtained from purchased, rented, or third-party lists for the purpose of unsolicited or cold messaging.

  • Engage in Spamming: Do not send unwanted, repeated messages to recipients. Ensure your communications are targeted, relevant, and welcomed by the recipients.

  • Promote Prohibited Substances: Do not send messages that promote the sale or use of illegal or prohibited substances.

  • Message Minors: Do not send messages to individuals under the age of consent in their respective jurisdiction.

2. User Responsibilities

  • Automated Opt-Out: Ensure that your messaging campaign includes a clear, straightforward automated opt-out mechanism for recipients to easily unsubscribe from future communications.

  • Compliance with SMS Regulations: You must comply with all relevant regulations and guidelines related to SMS messaging in your country. It is your responsibility to stay informed and adhere to these laws.

  • Ethical Conduct: You agree to conduct your messaging campaigns ethically and responsibly, respecting the privacy and preferences of your recipients.

  • Indemnification: You agree to indemnify, defend, and hold harmless JAG Digital and its affiliates, officers, agents, employees, and partners from any claims, liabilities, damages, and expenses (including, without limitation, reasonable attorneys' fees) arising from or related to your use of this Service in in any form.

3. Delivery

Please be aware that SMS delivery is subject to the complexities and variabilities of mobile networks and technologies across different carriers and regions. Despite our efforts to ensure reliable and timely delivery, issues such as network disruptions, compatibility differences among carriers, or technical malfunctions can occasionally prevent the successful transmission of SMS messages.

By using our services, you acknowledge these limitations and agree that we are not liable for any delays or failures in the delivery of SMS messages that arise from such factors beyond our control.

4. Termination

We reserve the right to terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach this Agreement. Upon termination, your right to use the Service will cease immediately.

4. Changes to This Agreement

We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
